4legal Status of Foreigners of Turkish Descent in Terms of Their Employment in Türkiye

Under Turkish law, foreigners must obtain a work permit from the Mi-nistry of Labor to work. There are also professions such as dentistry, pharmacy, and lawyering, which foreigners cannot practice even with a work permit, and which only Turkish citizens are allowed to practice. Pursuant to Law No.2527, fo-reigners of Turkish descent may work in all professions, including those that are only permitted to be practiced by Turkish citizens, by obtaining an exceptional work permit. Nevertheless, their applications for work permits may be rejected. In the case of a foreigner of Turkish descent of Macedonian nationality who app-lied for a work permit to work as a lawyer in Istanbul, the ministries rejected the application. The reason given was that the Directive on Citizenship stipulates that only citizens of Turkish descent from certain countries will be granted work permits. By the decision of the Administrative Court, which was upheld by the Council of State, since Law No.2527 is a “special law” in comparison to the Law on Lawyers, which restricts the practice of law to Turkish citizens, Turkish des-cendants may exceptionally obtain work permits. On the other hand, in a case filed for the annulment of the Directive, the Council of State rejected this requ-est. In another case, an application for a work permit based on Turkish ancestry was rejected based on the opinion of the Ministry of Interior, and this rejection was upheld by the Council of State as lawful. Despite the clear provisions in the law, both the practice of the government and the decisions of the courts are not uniform. In this article, the legislation and court decisions that foreigners of Tur-kish descent are subject to in terms of working in Türkiye will be examined and their legal status and the practice that they should be subject to will be revealed.
