Synopsis
Transitional Justice as a process is very constructive in a sense of judicial and non-judicial measures that post-conflict society can implement regarding the massive human rights. This paper aims to analyze the Transitional Justice and reconciliation process in general and with a special empathize in Kosovo Case in particular. The focus will be on process sustainability over years and how the international community and local institutions deal with this complex process. Moreover, the focus of our analysis with be the war crimes that happened in Kosovo during 1998-99. The paper will present an overall conceptualization of the Transitional Justice process in one part and the other part a full analysis will be conducted regarding the Transitional Justice process in Kosovo Case. The paper will include data documentation about the process, strong and weak parts, the actors that included in the process, benefits that Kosovo State has from the process, and at the same time how the internal and external actors can indicate in this ongoing process. In the end, after the presentation of this paper with the conduced analyze we can come to a conclusion about stages of the process in the Kosovo Case how a place could adopt the development of this process. Where are the process’s strengthens and weaknesses, is this a failure process, and what are the best ways for this process to be fulfilled by all actors. The elaboration and analysis of all the processes from causes to consequences that war crimes caused in Kosovo will help us to understand clearly the question How Kosovo people and Kosovo institutions are dealing with the past? What should be done that this process develops in the spirit of seeking justice for all the victims of the Kosovo Conflict during years?
